Image © Hypothetically, imagine you have done something morally very wrong... Obviously, you don’t wont the whole world to know.... Your good friend Twitter, however, just can’t stop updating everyone on your business. Unfortunate, right? Twitter logoWell... perhaps for those whom are super rich this may be a thing of the past. According reports this morning, Twitter may be forcefully silenced on issues that are court matters, better known as, an expensive super injunction; a little controversial. you might say... Primarily Britain is and always has been a place where freedom of speech is hugely championed and enjoyed by all. Super injunctions undeniably go against this, and so would any kind of restrictions on Twitter. We are not all ridiculously wealthy, most of us can’t even fathom being able to pay a court off so stories about us don’t spread, let lone actually having a platinum card to so with. In opposition to this, there are a number of cries for personal privacy and protection of the innocent, most understandably so in cases where children are involved. Currently, the work of the courts is being undone by Twitters inevitable need to gossip... If this was your family on the line, would you want to silence Twitter as well... ...Or perhaps would you take it as harsh lesson that needed to be learnt. We are all taught at a young age, our actions have consequences, it doesn’t sit comfortably with me that money should money really be the deciding factor in whose consequences get to ruin their lives and whose get to be swept under the proverbial carpet. Twitter will potentially be facing a legal battle over this very promptly, watch this space (You can follow Catch21 on Twitter as well!)

Twitter Vs. The Super Injuction

    Twitter is a US company, run on systems located outside of the UK, as a result they are not subject to UK laws on publishing these names. These super-injunctions only apply to UK based organisations and residents, who are under the jurisdiction of UK courts.

    If an American went online and published all of these celebrity names alongside their supposed iniscretions he/she would not face any censure from UK courts, it will be the same with Twitter.

    Only legal action undertaken in the United States could affect twitter and if you pay any attention to the libel situation you will see that frequently US citizens engage in libel tourism. That is they choose to pursue legal remedies in countries outside of the United States due to that countries constitutional right to free speech. Invariably they choose the UK due to its pretty strong libel laws.

    The content of this blog was founded upon the material printed in British newspapers on the day of writing. The point with this piece was not to interrogate the privacy laws of various countries, but to question the moral standing of these injunctions and the part social media has and is playing in the row.
